2008年，廣西壯族自治區(qū)積極實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略，知識(shí)產(chǎn)權(quán)保護(hù)狀況持續(xù)改善。
一、保護(hù)知識(shí)產(chǎn)權(quán)能力建設(shè)取得新進(jìn)展
截至2008年底，累計(jì)32個(gè)縣（市、區(qū)）掛牌建立知識(shí)產(chǎn)權(quán)局；中國(guó)（廣西）知識(shí)產(chǎn)權(quán)維權(quán)援助中心正式成立；全年培訓(xùn)知識(shí)產(chǎn)權(quán)專門人才1500多人（次）；開展知識(shí)產(chǎn)權(quán)宣傳周等宣傳活動(dòng)，公眾知識(shí)產(chǎn)權(quán)保護(hù)意識(shí)提高。
二、專利保護(hù)卓有成效
2008年，全區(qū)提交專利申請(qǐng)3884件，獲專利授權(quán)2228件。專利受理能力形成，國(guó)家專利局南寧代辦處受理專利申請(qǐng)1914件；積極開展“雷雨”、“天網(wǎng)”行動(dòng)，打擊了知識(shí)產(chǎn)權(quán)侵權(quán)、假冒等違法行為；簽訂了《西部十二省市區(qū)專利行政執(zhí)法協(xié)助協(xié)議》，建立了專利執(zhí)法區(qū)域協(xié)作機(jī)制。
三、商標(biāo)保護(hù)成效顯著
截至2008年底，全區(qū)注冊(cè)商標(biāo)累計(jì)5萬(wàn)多件，馳名商標(biāo)13件，廣西著名商標(biāo)249件。查處商標(biāo)侵權(quán)違法案件899件，沒(méi)收并銷毀侵權(quán)商品16.85萬(wàn)件、侵權(quán)商標(biāo)標(biāo)識(shí)10.6萬(wàn)件。安排專項(xiàng)資金，引導(dǎo)企業(yè)開展產(chǎn)品國(guó)際認(rèn)證、商標(biāo)注冊(cè)和出口品牌建設(shè)項(xiàng)目153個(gè)。
四、版權(quán)保護(hù)邁上新臺(tái)階
辦理著作權(quán)登記347件、涉外圖書版權(quán)貿(mào)易合同登記備案205份。檢查出版物市場(chǎng)、攤點(diǎn)2.4萬(wàn)家（個(gè)），收繳侵權(quán)盜版出版物、音像制品63.3萬(wàn)冊(cè)（張），查處侵權(quán)盜版案件659起。
五、海關(guān)保護(hù)水平不斷提升
2008年，南寧海關(guān)查獲侵權(quán)案件120起，貨值近百萬(wàn)元，查獲案件數(shù)在全國(guó)海關(guān)排第14位；出臺(tái)了《扶持保護(hù)自主知識(shí)產(chǎn)權(quán)企業(yè)工作方案》，加大了海關(guān)保護(hù)企業(yè)知識(shí)產(chǎn)權(quán)的力度。
六、音像市場(chǎng)進(jìn)一步規(guī)范
2008年，全區(qū)檢查音像生產(chǎn)經(jīng)營(yíng)單位122.75萬(wàn)家（次），收繳侵權(quán)盜版音像制品121.08萬(wàn)盒（張），銷毀100.66萬(wàn)盒（張），停業(yè)整頓文化經(jīng)營(yíng)場(chǎng)所71家，取消經(jīng)營(yíng)資格13家，辦結(jié)案件1271件。
七、植物新品種保護(hù)取得新成效
2008年上半年，全區(qū)共發(fā)放農(nóng)作物種子生產(chǎn)許可證副證61份，全年共處理品種侵權(quán)案件16件�！肮馃o(wú)1號(hào)”等油茶優(yōu)良無(wú)性系林木品種通過(guò)審定。
八、地理標(biāo)志產(chǎn)品保護(hù)再創(chuàng)佳績(jī)
2008年，全區(qū)新增8個(gè)地理標(biāo)志產(chǎn)品，截至2008年底，全區(qū)共有34個(gè)產(chǎn)品獲得地理標(biāo)志37個(gè)。制定和發(fā)布20個(gè)地理標(biāo)志產(chǎn)品地方標(biāo)準(zhǔn)，建成4個(gè)地理標(biāo)志產(chǎn)品公共檢測(cè)技術(shù)平臺(tái)。
九、知識(shí)產(chǎn)權(quán)司法保護(hù)能力增強(qiáng)
公安機(jī)關(guān)立案?jìng)刹橹R(shí)產(chǎn)權(quán)犯罪案件16起，涉案金額4126.68萬(wàn)元。檢查機(jī)關(guān)受理審查逮捕知識(shí)產(chǎn)權(quán)犯罪案件16件38人。法院受理知識(shí)產(chǎn)權(quán)民事案件247件，審結(jié)181件，同比增長(zhǎng)14.6%。
十、國(guó)際交流和涉外展會(huì)知識(shí)產(chǎn)權(quán)保護(hù)不斷加強(qiáng)
2008年，美國(guó)駐華大使館高級(jí)知識(shí)產(chǎn)權(quán)專員成功訪桂；成功舉辦“東盟國(guó)家駐邕領(lǐng)事機(jī)構(gòu)及廣西外商投資企業(yè)保護(hù)知識(shí)產(chǎn)權(quán)工作座談會(huì)”；積極開展第五屆中國(guó)-東盟博覽會(huì)知識(shí)產(chǎn)權(quán)舉報(bào)投訴工作。
Summary of Intellectual Property Protection in Guangxi Zhuang Autonomous Region in 2008
Thank to the earnest implementation of intellectual property strategy, continuous progress had been made in Guangxi Zhuang Autonomous Region in 2008 in the field of intellectual property right protection.
I. New Headways had been Made in Capacity-building
By the end of 2008, a total of 32 Bureaus for intellectual property right protection had been established at county (city or district) level. In 2008, China (Guangxi) Intellectual Property Rights Aid Centre was formally launched. Over the year, a total of 1,500 person (times) had been trained on intellectual property rights protection. In addition, public awareness had been lifted through a series of publicity activities, such as Intellectual Property Rights Protection Publicity Week.
II. Substantial Achievements had been Made in Patent Protection
A total of 3,884 patent applications were submitted in 2008, of which 2,228 were awarded with patents. With the handling of 1,914 patent applications over the year, Nanning Agency of the State Intellectual Property Office had greatly boosted its capacity. With the launch of special crackdown operations like the “Thunder Storm” and “Sky Net”, illegal activities such as intellectual property rights infringement and counterfeiting were dealt with heavy blows. In 2008, 12 provinces, cities and districts in western China signed the Assistance Agreement on Patent Enforcement, which helped to establish a regional assistance mechanism for patent enforcement.
III. Remarkable Progress had been Made in Trademark Protection
By the end of 2008, an accumulation of 50,000 trademarks had been registered, of which 13 were well-know ones and 249 were famous trademarks in Guangxi. Over 2008, 899 cases of trademark infringement were investigated and 168,500 pieces of counterfeit articles and 106,000 pieces of infringement trademarks were confiscated and destroyed. In 2008, we earmarked special fund to encourage various enterprises to undertake 153 projects in international certification, trademark registration and export brand building.
IV. Copy Right Protection Steps onto a New Phase
In 2008, a total of 347 cases of copyright application were registered and 205 copies of foreign-related book copyright trading contract were filed. Over the year, a total of 240,000 publication markets and stalls were examined, a total of 633,000 books and audio-video discs were confiscated and 659 cases of copyright infringement were investigated.
V. The Role of Customs in Intellectual Property Right Protection was Constantly Enhanced
In 2008, Nanning Customs investigated a total of 120 infringement cases, involving a total worth of nearly 1 million RMB, ranking the 14th across the country. Over the year, Working Plan for Supporting and Protecting Enterprises with Independent Intellectual Property Rights was put into place so as to enhance the role of customs in protecting enterprises’ intellectual property rights.
VI. The Audio-video Products Market was Further Rectified
In 2008, an accumulation of 1,227,500 audio-video product manufacturing enterprises were examined and 1,210,800 pieces of counterfeit audio-video products were confiscated, among which 1,006,600 pieces were destroyed. 71 cultural and entertainment facilities were closed down for rectification, among which 13 were revoked of their licenses. The number of settled cases stood at 1,271.
VII. New Achievements had been Made in the Protection of New Varieties of Plants
In the first half of 2008, a total of 61 copies of crops seed production certificates were issued and 16 cases involving breed infringements were investigated. Fine clonal breeds of camellia (oil tea), such as “Gui Wu No.1” passed expert review.
VIII. New Breakthrough had been Made in the Protection of Geographic Indication Products
The year of 2008 witnessed the new addition of 8 geographic indication products. By the end of 2008, there were 34 products in the Autonomous Region which were entitled to 37 geographic indications. 20 local-level standards on geographic indication were formulated and promulgated and we had established 4 public test technique platforms for geographic indication products.
IX. Judicial Capacity of Intellectual Property Right Protection was Greatly Enhanced
In 2008, pubic security organs filed and investigated a total of 16 cases involving intellectual property right infringement with a total worth of 41.2668 million RMB. The procuratorial organs accepted 16 intellectual property right infringement cases and approved the arrest of 38 people. Courts in Guangxi accepted 247 civil cases on intellectual property right infringement, of which 181 were settled, marking an increase of 14.6%.
X. International Exchanges and Intellectual Property Rights Protection for Foreign Exhibitions were Further Strengthened
In 2008, the Intellectual Property Attache of the U.S Embassy in Beijing visited Guangxi. The Working Seminar on Intellectual Property Right Protection for Consular Agencies by ASEAN Countries and Foreign-Funded Enterprise in Guangxi was held successfully. Great efforts had been made to handle the complaints and information on intellectual property right protection during the 5th China-ASEAN Expo.
