2011年國家知識產權戰略實施推進計劃(中英文)
為貫徹中央關于加快轉變經濟發展方式的總體要求,全面落實《國家知識產權戰略綱要》部署,按照“鞏固基礎,分解任務,全面展開,重點推進”的工作思路,推動2011年國家知識產權戰略實施工作深入有效開展,特制定本計劃。
★(1)頒布實施戰略性新興產業發展規劃和配套政策,研究制定戰略性新興產業發展指導目錄和重點新興產業行業標準,統籌啟動組織實施相關產業重大工程和一批重大產業化示范項目,推進知識產權創造和運用。
(2)繼續引導和支持創新要素向企業聚集,加快培育擁有自主創新能力、自有品牌和具有國際競爭力的大企業(集團),支持大型骨干企業建設具有國際先進水平的技術研發中心,支持、推進中小企業創新發展,進一步強化企業的創新主體地位。
★(3)落實國家科技計劃和重大專項知識產權管理措施,完善國家科技計劃知識產權管理辦法,根據《國家科技重大專項知識產權管理暫行規定》,制定知識產權管理細則,推動制定各專項知識產權工作方案,制定符合各專項科技創新和產業化特點的知識產權戰略。
(4)建立國家科技計劃和重大專項知識產權組織工作體系,推動各計劃吸收知識產權專家參加專家咨詢委員會,明確各計劃管理(組織)單位和項目承擔單位、各專項牽頭組織單位和責任單位的知識產權責任主體。
(5)研究建立國家科技計劃和重大專項成果向境外的組織或者個人轉讓的審批制度,建立健全國家科技計劃和重大專項知識產權信息登記、統計與評估制度,落實國際合作知識產權管理辦法,完善國際科技合作項目知識產權保護措施。
(6)探索建立國家科技計劃所形成的科技成果、知識產權、技術標準等的發布機制,加強重大科技成果及其知識產權的宣傳推廣。
(7)完善國家科學技術獎評審標準中的知識產權評價辦法,開展知識產權評價標準的研究工作,對國家科學技術獎獲獎項目知識產權產出和保護狀況進行跟蹤評估。
(8)研究制定《工業和信息化部關于加強行業知識產權工作的指導意見》,完善行業知識產權工作機制。
(9)依據《中國生物多樣性保護戰略與行動計劃》(2011—2030年),加強生物遺傳資源的開發利用與創新研究,研究建立生物遺傳資源及相關傳統知識保護、獲取和惠益共享的制度和機制。
(10)推廣使用植物品種權交易合同規范文本,促進品種權交易規范化。
(11)完善原創動漫產品的評選、獎勵和推廣機制,加大對原創動漫生產創作和推廣傳播的支持力度,加強動漫產業內容建設與引導,研究出臺加強動漫知識產權保護的措施。
(12)促進《醫藥衛生知識產權管理規定》的實施,以“艾滋病和病毒性肝炎等重大傳染病防治”和“重大新藥創制”科技重大專項作為醫藥創新知識產權管理工作的重點,規范科技創新項目的知識產權管理,對重大產品和核心技術的專利予以有效保護,促進創新成果的轉化、利用、合理分享。
(13)貫徹落實《廣播影視知識產權戰略實施意見》,提高廣播影視自主知識產權作品的數量和質量,做好知名和成熟欄目名稱、標識的注冊和日常檢測保護工作,鼓勵廣播影視數字化、移動多媒體廣播電視推廣等具有自主知識產權的高新技術項目發展,支持廣播電視播出機構建立媒體資產管理系統。
(14)加強版權貿易基礎性建設,積極構建綜合性的版權要素市場,鼓勵民營資本和社會力量參與版權貿易,支持版權代理、版權評估、版權投融資活動,逐步完善版權交易市場機制。
(15)進一步貫徹落實《全國版權示范城市、示范單位、示范園區(基地)管理辦法》,批準一批版權示范主體,大力推動版權示范城市、示范單位和示范園區(基地)建設。
(16)支持辦好2011年北京國際圖書博覽會、全國圖書交易博覽會等重大版權交易展會,充分發揮大型展會推進版權市場運用的重要作用。
(17)通過政策引導、資金扶持,推動林業重點技術領域自主知識產權創造水平提高和具有自主知識產權重大創新成果產業化,將已審批的優良新品種通過多種形式進行示范推廣,實施優良新品種推廣示范工程。
(18)繼續實施中小企業知識產權戰略推進工程,重點做好試點的組織、評價工作,通過加大政策引導和服務培育力度,形成一批知識產權優勢中小企業。
(19)開展地方重大經濟科技活動知識產權評議機制試點工作,為地方經濟和科技活動的決策提供支撐。
(20)對試點示范單位開展分類指導與服務,培育一批國家和地方自主知識產權優勢企業。
★(21)切實做好《關于加強知識產權質押融資與評估管理 支持中小企業發展的通知》的具體落實工作,支持和規范企業知識產權質押融資,創新中小企業知識產權評估與投融資服務機制。
(22)建立非職務發明評價體系,研究國家引導鼓勵個人和中小企業發明創造的辦法。
(23)通過信息發布、專利孵化、院地合作等多種平臺,促進產學研結合,加快科技成果轉移轉化,服務經濟社會建設。
(24)在軍民融合式發展的國防科研生產體系中,探索國防知識產權的創造和應用方式。
1.專利、商標、版權法律法規和規章
(25)做好修改《專利代理條例》工作。
(26)修改《專利實施強制許可辦法》。
(27)研究制定《職務技術成果條例》和《職務發明人流動中利益共享辦法》。
(28)做好《商標法》修改工作,加快立法進程,啟動《商標法實施條例》修改的調研工作。
(29)積極推進《著作權法》及其配套法規的修改工作。
(30)加快《民間文學藝術作品著作權保護辦法》立法進度。
(31)制定《教科書法定許可付酬辦法》,推動《作品自愿登記試行辦法》修訂。
2.其他法律法規和規章
(32)繼續推進《生物遺傳資源管理條例》的立法協調工作。
(33)開展《植物新品種保護條例》修訂工作,研究《植物新品種保護法》的立法可行性。
(34)推進《對外貿易法》中“與對外貿易有關的知識產權保護”相關配套規章制定工作,協調起草《知識產權濫用反壟斷指南》。
(35)加快《中醫藥法》的立法進程,繼續做好《中醫藥法》立法的溝通協調工作,加強中醫藥傳統知識保護。
(36)完成對《知識產權海關保護條例》實施辦法的修訂工作。
(37)完善《涉及專利的國家標準制修訂管理規定(暫行)》。
(38)研究制定并發布林業植物新品種權審批規則。
(39)做好《反不正當競爭法》修改工作,在《反不正當競爭法》修訂完成后,著手配套實施細則的起草、調研工作。
(40)組織開展《國防專利條例》修訂工作,制定國防知識產權相關規章。
3.司法解釋和規范性文件
(41)發布《最高人民法院關于在部分地方人民法院試行由知識產權庭集中審理知識產權民事、行政和刑事案件的若干意見》。
(42)出臺《最高人民法院關于審理壟斷民事糾紛案件適用法律若干問題的規定》。
(43)制定《關于辦理侵犯知識產權刑事案件適用法律若干問題的意見》。
(44)完成網絡環境下的著作權司法保護調研,起草關于審理網絡著作權案件的司法解釋。
(45)適時起草關于專利、商標授權確權行政案件審判標準和商業秘密司法保護的指導性意見。
(46)發布《關于加強知識產權司法保護 積極促進經濟發展方式加快轉變若干問題的意見》。
(47)繼續修改并適時下發實行《企業職工檔案管理規定》及《貫徹執行勞動合同法若干意見》等勞動法律配套規章,完善有關競業限制等商業秘密保護政策。
(48)配合《非物質文化遺產法》的施行,研究制定《非物質文化遺產生產性保護扶持政策》、《非物質文化遺產傳承人及傳承機制建設政策》、《國家級非物質文化遺產名錄項目分類保護規范》、《國家級文化生態保護區總體規劃編制規范》、《非物質文化遺產珍貴實物管理辦法》、《人口較少民族非物質文化遺產保護政策》等政策或指導性文件。
(49)啟動對企業知識產權管理規范的研究制定和推行工作,出臺相關文件。
1.開展專項行動
★(50)全面貫徹落實《打擊侵犯知識產權和制售假冒偽劣商品專項行動方案》,組織協調專項行動開展,推動我國保護知識產權長效機制建設。
★(51)大力推進政府部門和企業使用正版軟件工作,采取有效措施,確保中央和地方政府機關2011年按期完成正版化檢查整改工作,配合財政和國家機關事務管理部門做好經費保障和軟件資產管理,構建使用正版軟件、抵制盜版軟件的長效工作機制;加大推進企業使用正版軟件工作力度,充分發揮行業協會在企業軟件正版化工作中的積極作用,加快推進外資、民營企業軟件正版化工作,做好30家企業軟件資產管理試點工作。
★(52)開展打擊網絡侵權盜版行為的專項行動,加強對互聯網站的主動監管,加大對網絡侵權案件打擊力度,重點打擊利用互聯網銷售假冒偽劣商品、提供盜版影視作品、軟件下載服務以及運營網絡游戲私服、外掛等侵權犯罪活動,加強網絡知識產權保護,建立網絡版權行政保護的常態化機制。
(53)繼續推進打擊侵犯知識產權和制售偽劣商品犯罪的“亮劍”專項行動,強化指導協調和督促檢查,確保全國專項行動整體推進。
(54)按照《關于做好全國打擊侵犯知識產權和制售假冒偽劣商品專項行動律師工作的通知》的要求,組織引導律師做好侵犯知識產權和制售假冒偽劣商品犯罪案件的辯護代理工作。
(55)組織全國農業行政部門實施《打擊侵犯品種權和制售假冒偽劣種子專項行動方案》,曝光一批侵權假冒企業,滅活處理一批假冒偽劣授權品種種子。
(58)根據打擊侵犯知識產權和制售假冒偽劣商品專項行動要求,在全國海關范圍內積極推進和部署,繼續保持打擊進出口侵權違法行為的高壓態勢,通過多種途徑和方式加強對侵權信息的分析和處理,不斷完善與知識產權權利人的配合機制,對進出口侵權商品的違法行為實施精準打擊。
(59)提高打擊侵犯知識產權和制售假冒偽劣商品專項行動實效,重點查處侵犯涉外商標和馳名商標的違法行為,切實扼制惡意商標搶注行為,嚴厲查處違法印制商標標識及仿冒知名商品包裝裝潢的行為。
(60)推進和落實打擊生產領域侵犯知識產權和制售假冒偽劣產品專項行動各項工作,集中整治一批重點地區,并積極探索建立打擊假冒保護知識產權的長效工作機制,大力推進“12365”舉報處置指揮系統建設,繼續深入推進“打擊假冒,保護名優”工作。
(61)組織“打擊侵犯知識產權和制售假冒偽劣商品專項行動”重點地區查繳盜版出版物集中銷毀活動,對重點案件進行掛牌督辦,限時辦結。
(62)組織開展打擊制售假劣林木種苗和保護植物新品種權專項行動,嚴厲打擊制售假劣林木種苗、依法查處無證無簽生產經營林木種苗、新品種侵權和假冒等違法行為,依法保護育種者權益。
(63)組織落實《知識產權系統執法專項行動方案》,堅決打擊反復、群體、惡意侵權及假冒專利行為,加大接受知識產權舉報投訴力度,推進知識產權維權援助中心建設,強化展會知識產權保護,加強部門間區域間執法協作,推動行政執法與司法保護協調配合,切實做好執法檢查與督導工作。
(64)依法積極配合打擊侵犯知識產權和制售假冒偽劣商品專項行動,加大知識產權刑事司法保護力度,依法嚴厲制裁侵犯知識產權犯罪行為,充分發揮懲罰和震懾犯罪功能。
(65)積極參與打擊侵犯知識產權和制售假冒偽劣商品專項行動,依法嚴厲打擊侵犯知識產權的犯罪,及時予以批捕和起訴,對重大、有影響的案件加強督辦。
2.加強日常執法
(66)組織編寫辦理侵犯知識產權犯罪案件指導手冊,幫助一線執法人員正確理解和適用相關法律,規范受案、辦案工作。
(67)加強DNA等執法鑒定技術研究,制定主要作物的DNA指紋圖譜鑒定規程,支持建立有資質的品種鑒定機構,完善品種權執法鑒定執法體系。
(68)積極開展計算機預裝盜版軟件的市場治理,集中加強對計算機生產企業的源頭治理,加大對軟件等重點產品的市場監管力度。
(69)出臺《版權行政執法指導意見》,進一步完善版權行政執法體制,支持文化市場行政執法機構開展版權執法工作。
(70)推動建立版權爭議調解機制,基本形成司法和行政有機銜接的版權爭議民事調解機制。
(71)組織制定發布《2011年中國保護知識產權行動計劃》。
(72)推進知識產權維權援助中心建設,深入開展“5·26”執法推進工程和全國專利保護重點聯系基地工作。
(73)做好地理標志保護工作,加大監督抽檢力度,嚴厲打擊地理標志侵權假冒行為。
3.加強知識產權司法工作
(74)繼續積極推動知識產權審判庭統一受理知識產權民事、行政和刑事案件的試點工作。
(75)有效完善知識產權民事案件管轄制度,進一步擴大管轄一般知識產權案件的基層法院的范圍,完善已指定法院的地域管轄范圍。
(76)實施加強知識產權審判基層基礎建設“三五工程”,選擇具有知識產權案件管轄權的五個基層法院作為首批中國知識產權司法保護基層示范法院,選擇五個中院作為首批最高人民法院知識產權司法保護研究基地,在全國范圍內選擇五所重點高校作為首批中國人民法院知識產權司法保護研究基地。
(77)開展“對行政執法機關移送涉嫌犯罪案件專項監督活動”,依法嚴肅查辦行政執法部門有案不移、有案不立、有罪不究、以罰代刑、徇私舞弊等行為,及時予以監督糾正。
(78)進一步推動“兩法銜接”工作,積極推動行政執法與刑事司法機關建立“網上銜接,信息共享”機制。
三、發展知識產權服務
(79)在技術市場、孵化器、大學科技園、生產力促進中心等中介服務機構中強化知識產權服務內容,提高知識產權服務能力。
(80)支持開展重點領域知識產權信息加工和戰略分析,整合重點領域知識產權信息資源,推動重點領域知識產權信息共享,向國家科技計劃項目承擔單位開放使用。
(81)組織制定知識產權司法鑒定分類規范、準入條件、執業規則等知識產權登記管理相關文件。
(82)就律師從事專利、商標代理業務的相關問題加強溝通協調,為律師從事專利代理業務創造條件,推動律師從事商標代理業務的規范性文件出臺。
(83)研究制定《律師從事專利業務指引》、《律師從事商標業務指引》等指導性業務操作指南,幫助全國律師開展專利、商標等知識產權業務。
(84)吸納更多的知識產權中介組織為實施農業知識產權戰略綱要服務,支持農業企事業單位和社會組織以農業知識產權為紐帶開展相關服務活動,指導種業知識產權聯盟開展種業知識產權信息共享和維權救助工作。
(85)繼續做好植物新品種保護技術支撐體系建設規劃的落實工作,完善植物新品種測試機構功能和區域布局,努力建設世界一流的植物新品種測試體系。
★(86)繼續通過多種方式發布企業知識產權海外預警和指導信息,通過編寫知識產權海外維權年度報告、發布行業專利技術分析報告、對企業進行知識產權保護培訓、繼續在境外知名展會上設立“中國參展企業知識產權服務站”等多種方式健全知識產權海外維權機制,指導和協助我國企業處理對外經貿關系中的重點涉外知識產權糾紛,推動企業知識產權海外維權中心試點。
(87)定期開展中美337調查交流,積極組織對337調查的立法修訂進行評議,表達我國內產業、企業關注,加強對重大案件企業的應訴指導,同時對在337調查中取得勝訴的企業,努力協調各部門給予政策支持和幫助。
(88)推進非物質文化遺產保護信息化建設,制定非物質文化遺產數字化保護工程建設方案,制定全國統一的非物質文化遺產數字化標準體系,統籌規劃非物質文化遺產數據庫建設,初步建立起提供公眾服務的數據庫群。
(89)繼續支持動漫公共技術服務平臺建設,制定動漫公共技術平臺服務規范標準,建設好動漫公共信息服務平臺,建設動漫公共素材庫。
(90)推動《關于加強中醫藥知識產權工作的指導意見》的實施工作,通過組織培訓等,提高行業創造、運用、管理知識產權的能力。
(91)在徹底解決商標審查積壓的基礎上,繼續推動實施商標工作五年達到國際水平的工作計劃。
(92)切實加強商標基礎建設,繼續做好商標注冊網上申請,并積極擴大范圍和提高網上申請率,繼續推進與世界知識產權組織就建設馬德里電子通訊系統的合作。
★(93)繼續推進廣播影視知識產權行業組織建設,指導電影著作權協會、中國廣播電視協會電視版權委員會、中國廣播電視協會廣播版權委員會開展工作,繼續推進中國網絡視聽節目服務協會的籌建工作。
(94)充分利用上海國際電影節、“北京放映”等廣播影視節展活動,為廣播影視作品的著作權人和相關權利人提供節目交流和版權營銷平臺,抓好影視劇國際營銷網絡建設,鼓勵企業面向國際市場開展節目版權交流和營銷。
(95)充分發揮集體管理組織、行業協會和版權中介機構的作用,進一步規范其市場行為,支持其依法開展業務活動,為其發展創造條件。
(96)創新版權公共服務形式,增強版權公共服務能力,提高作品登記和著作權合同登記備案的質量和數量。
(97)重點建設和完善林業植物新品種、與林業有關的專利、地理標志等內容的林業知識產權基礎數據庫,進一步完善林業知識產權公共信息平臺和重點出口林產品知識產權預警機制,啟動“中國林業知識產權網”,支持組建多種形式的保護聯盟,為林業植物新品種的創造、保護與運用提供服務。
★(98)印發實施《加強全國專利分析工作的指導意見》,培育全國專利分析工作體系,選擇科技重大專項、重點產業和重大技術領域深入開展專利分析工作,開展專利分析普及推廣項目。
(99)選擇重點行業或重大技術領域開展行業知識產權戰略工作,增強行業知識產權意識,提高行業知識產權創造、運用、保護和管理能力,推動建立行業知識產權管理機制。
(100)持續開展專利電子申請推廣,完善電子申請系統,加快推進紙件轉電子申請系統改造項目,采取一攬子措施推進電子申請。
(101)繼續推進專利信息公共服務工作,建設戰略性新興產業專利信息服務平臺,完善重點產業專利信息服務平臺,開展專利信息應用優勢行業協會培育工程。
(102)建立專利代理援助機制,細化操作規范,實施專利代理機構能力提升計劃,全面提高專利代理服務水平。
(103)開展全國專利運用與產業化公共服務平臺體系建設,提高平臺的信息化水平,強化平臺的知識產權綜合服務能力。
(104)穩步落實《海峽兩岸知識產權保護合作協議》,進一步加強兩岸在專利、商標、版權、植物新品種等領域的合作。
(105)加強國防專利審批能力建設,穩步擴大審查員隊伍,優化審批流程,加強國防知識產權中介服務機構建設,建立和完善行業管理規范,逐步拓展國防知識產權服務的廣度和深度。
★(106)將國家知識產權人才培養基地建設納入2011年啟動實施的“卓越法律人才教育培養計劃”,加強知識產權專業人才培養。
(107)繼續開展短期師資培訓工作,舉辦“全國高校知識產權師資培訓班”,進一步加強高水平師資隊伍建設。
(108)繼續鼓勵和引導高校設置知識產權相關專業,引導高校面向廣大學生開設知識產權相關領域的輔修課程。
(109)針對各類創新主體和科技管理人員分層次開展知識產權知識培訓和實務輔導,依托科技信息機構、科研機構、大學和高新技術產業開發區,培育一支專利信息分析隊伍,為科技創新提供知識產權信息支撐。
(110)繼續推進在職攻讀法律碩士專業學位教育知識產權方向班研究生培養工作。
(111)加大知識產權司法鑒定人崗前培訓和繼續教育力度,開展職業道德和執業紀律教育,進一步提高隊伍整體素質。
(112)大力吸引海外知識產權高層次人才以多種形式為國服務,進一步加大對回國留學人員中知識產權方面高層次人才回國工作、創業的支持力度。
(113)按照專業技術人才知識更新工程的部署,組織開展知識產權公需科目繼續教育培訓,制定實施專項培訓計劃,為企業開展知識產權培訓和輔導,并將培訓考核情況列入專業技術人員繼續教育考核登記內容。
(114)進一步加強公務員知識產權培訓,加大指導和監督力度,繼續將知識產權培訓納入各類培訓,提高公務員知識產權保護意識。
(117)加強版權培訓工作,開展領導干部、執法人員、著作權人、版權相關企業經營者版權培訓,培養版權專業人才。
(118)按照《國家中長期人才發展規劃綱要(2010—2020年)》任務分工方案要求,做好落實“實施知識產權保護政策”的組織工作,出臺具體措施和辦法。
★(119)研究出臺2011—2015年“百千萬知識產權人才工程”實施方案,加快推進“知識產權人才培養基地建設工程”建設,深入實施“知識產權人才信息化工程”,建立知識產權專家庫和地方知識產權人才庫。
(120)進一步推進知識產權專員制度建設,加大知識產權專員培養力度,壯大知識產權專員隊伍,提高其知識產權戰略管理和策劃能力。
(121)將知識產權宣傳與回顧“十一五”展望“十二五”、加快轉變經濟發展方式宣傳結合起來統籌安排,充分報道我國實施國家知識產權戰略,加強知識產權創造、運用、保護和管理的顯著成果。
(122)進一步加強打擊侵犯知識產權和制售假冒偽劣商品專項行動的宣傳報道,及時報道各地區各部門采取切實措施,打擊侵犯知識產權和制售假冒偽劣商品,推進知識產權保護的進展成效,發揮輿論監督作用,報道專項行動查處的一批典型案例,曝光侵犯知識產權的行為,營造保護知識產權、自覺抵制侵犯知識產權和假冒偽劣商品的良好社會氛圍。
(123)結合國際輿論關注點,有針對性地加強知識產權對外宣傳,充分報道我國知識產權保護環境日益改善,展示我國政府嚴厲打擊侵犯知識產權的堅定決心,使國際社會客觀、公正、全面了解我國知識產權保護工作取得的積極成效。
★(124)在全國知識產權宣傳周、《國家知識產權戰略綱要》頒布紀念日等重要時間節點,圍繞活動主題,運用群眾喜聞樂見的方式,加強知識產權法律法規和科學知識的宣傳,增強全社會的知識產權意識,推動“尊重知識、崇尚創新、誠信守法”的知識產權文化建設。
(125)鼓勵地方和學校利用《義務教育課程設置方案》規定的可自主支配的課時,組織開展有關知識產權保護的教育活動,指導思想品德課教材編寫組根據課程標準關于知識產權內容的教育要求,修訂教材。
(126)利用“十一五國家重大科技成就展”等契機,加強我國科技創新知識產權工作成果的宣傳和推廣,積極營造科技創新的知識產權文化。
(127)開展重點產業重大技術發明評選活動,激勵企業創新。
(128)在報紙、廣播、電視等新聞媒體開辟知識產權專項行動專版、專欄,對公安機關打擊涉及民生的侵犯知識產權犯罪工作情況等進行專題宣傳,提升公眾知識產權意識,為推進知識產權戰略實施營造良好社會氛圍。
(129)通過《2011年全國普法依法治理工作要點》對知識產權法制宣傳教育作出部署,根據“六五”普法的要求,繼續深化“法律六進”活動,推動知識產權法律法規“進機關、進農村、進社區、進學校、進企業、進單位”。
(130)指導種業知識產權聯盟成員向全國種業發出誠信守法倡議書,結合國際植物新品種保護聯盟成立50周年,編制植物新品種保護宣傳冊,舉辦第五屆全國農業知識產權論壇。
(131)繼續深入開展知識產權海外維權和企業境外參展知識產權保護的宣傳活動,充分利用中國保護知識產權網、國家知識產權戰略網等平臺,做好知識產權信息發布與宣傳工作。
(132)舉辦藥品數據保護制度國際研討會,深入探討藥品試驗數據保護相關制度的實施策略。
(133)與世界知識產權組織共同頒發“中國商標國際金獎”,做好“商標戰略實施省長談”、“商標戰略實施市長談”工作,針對重點行業,與行業協會聯合召開加強自主品牌建設的研討會,普及商標知識,提高企業商標戰略意識。
(134)發揮廣播影視大眾媒體優勢,組織協調廣播電視播出機構積極開展《國家知識產權戰略綱要》的宣傳工作,大力宣傳保護知識產權和打擊制售假冒偽劣商品專項行動中的經驗成果。

The Promotion Plan for the Implementation of the National Intellectual Property Strategy in 2011
In order to fulfill the general requirements of the Central Committee on accelerating the transformation of the economic development mode, fully implement the Outline of the National Intellectual Property Strategy, and promote the intensive and effective implementation of the National IP Strategy in 2011, based on the working guidelines of "Strengthening Foundation, Allocating Tasks, Comprehensive Deployment, and Promotion with Focuses", this plan is formulated.
★ (1) To promulgate and implement development plans and supporting policies for emerging industries of strategic importance, to study and formulate the guidance catalogue for the development of emerging industries of strategic importance and the sector standards for key emerging industries, to initiate, coordinate, organize and implement some major projects of related industries and a group of demonstration projects of industrialization, so as to encourage the creation and utilization of intellectual property rights.
(2) To continue guiding and supporting the gathering of innovative elements moving towards enterprises, to accelerate the cultivation of large enterprises (groups) with the capabilities of indigenous innovation, self-owned brands, and international competitiveness, to support the large and major enterprises to establish internationally advanced research and development centers, and to support and promote the development of small and medium-sized enterprises, in order to strengthen the position of enterprises as the main body of technological innovation.
★ (3) To implement the IP management measures of the national scientific and technological plans and the major technological projects, to improve the IP management regulations of the national scientific and technological plans, and to formulate the IPR administrative rules, the IP working plans of each major technological projects, intellectual property strategies in accordance with the special characteristics of the scientific and technological innovation and industrialization under the Provisional Regulations on Intellectual Property Management of the Major National Scientific and Technological Projects.
(4) To establish the working system for managing intellectual property rights under the national scientific and technological plans and major technological projects, to promote all plans to include intellectual property experts in their advisory committees of experts, to specify the main body of IPR liabilities of the administrative (organization) units under all plans, program undertakers, leading and organizing units and specific-work undertaking units of the major technological projects.
(5) To study and establish the examination and approval system for the external transfer of major achievements of the national scientific and technological plans and major technological projects to foreign organizations or individuals, to establish and improve the system for information registration, statistics and assessment of intellectual property rights of the national scientific and technological plans and major technological projects, to implement the IPR management measures for international cooperation, and to improve the protection measures for intellectual property rights of international scientific and technological cooperation programs.
(6) To explore the possibility of establishing the promulgation mechanism of scientific and technological achievements, intellectual property rights, and technology standards resulting from the national scientific and technological plans, and to enhance the publicity and promotion of major scientific and technological achievements as well as their intellectual property rights.
(7) To improve the IPR evaluation measures in the assessment criteria of the National Science and Technology Awards, to carry out the research work of IPR evaluation criteria, and to conduct follow-up evaluation of the programs winning the National Science and Technology Awards on their ownership and protection situation of IPRs.
(8) To study and formulate the Guiding Opinions on Strengthening Intellectual Property Work in Industries of the Ministry of Industry and Information Technology so as to improve the IP working mechanisms in industries.
(9) To enhance the development, utilization and innovative research of the biological genetic resources, to establish the system and mechanism on protection, accessibility and benefit sharing of biological genetic resources and associated traditional knowledge, according to the Strategy and Action Plan on the Protection of Biological Diversity in China (2011-2030).
(10) To promote the use of model contracts of trading new varieties of plants, in order to improve the standardization in trading new varieties.
(11) To improve the selection, rewarding and promotion mechanisms of original comic and animation works, to increase the support on creation, production and popularization of original comic and animation works, to strengthen the guidance on the content construction of the comic and animation industry, and to promulgate measures for strengthening the protection of intellectual property rights of comic and animation works.
(12) To promote the implementation of the Regulation on Managing Intellectual Property Rights related to Medicines and Health, and to standardize the IPR management of scientific and technical innovation projects, provide effective patent protection on major products and core technologies, and promote the transfer, utilization and reasonable sharing of innovative achievements, with focuses on the IP management work of medicine and health innovation, such as major technological projects of “AIDS and viral hepatitis prevention and control of major communicable diseases” and “creation of major new drugs”.
(13) To implement the Opinions on the Implementation of the IP Strategy of Radio, Film and Television Programs , to improve the quantity and quality of radio, film and television programs with independent IPRs, to do a good job in the registration of the names and marks of well-known and popular programs as well as the routine protection work, to encourage the high-tech projects with independent intellectual property rights, such as “the digitalization technology of radio and television programs and films” and “the promotion of mobile multimedia broadcasting and TV programs”, and to support the radio and television stations to establish media asset management system.
(14) To strengthen the basic construction of copyright trade, to actively build a comprehensive factor market for copyright, to encourage private capital and social forces to participate in the copyright trade, to support copyright agency, copyright assessment, copyright investment and financing, and to gradually perfect the market mechanism for copyright trade.
(15) To further implement the Administrative Measures for the National Copyright Demonstration Cities, Demonstration Units and Demonstration Parks (Bases), to approve a number of copyright demonstration subjects, and to greatly promote the construction of copyright demonstration cities, demonstration units and demonstration parks (bases).
(16) To support the good organization of 2011 Beijing International Book Fair (BIBF), National Book Trade Fair and other important copyright trade fairs and exhibitions, giving full play to the role of the large-scale exhibitions in promoting the use of copyright market.
(17) To promote the creation of independently owned IPRs in key technical fields of forestry and the commercialization of important innovations with proprietary IPRs via policy guidance and financial support, to demonstrate and disseminate the approved excellent new varieties via various forms, and to implement the promotion and demonstration projects of excellent new varieties.
(18) To continue implementing the Promotion Project for the Intellectual Property Strategy of SMEs, focusing on the organization and assessment work on pilot programs, and to form a number of SMEs with an advantage in IPRs via enhancing policy guidance and service training.
(19) To organize pilot work on the IPR assessment mechanism of local major economic and scientific and technological activities, so as to support the policy decision making of local economic and scientific and technological activities.
(20) To conduct classified guidance and services to pilot and demonstration units, and to foster a number of national and local enterprises with an advantage in IPRs.
★(21) To do a good job in the implementation of the Circular on Strengthening the Financing, Pledge, Assessment, and Management of Intellectual Property Rights as well as Supporting the Development of SMEs, to support and standardize the IP pledge financing for enterprises, and to innovate mechanisms for IPR assessment, investment and financing services of SMEs.
(22) To build up a review system for non-service inventions, and to study measures for the country to encourage and guide individuals and small and medium-sized enterprises to innovate and create.
(23) To promote the integration of industries, universities and research institutes, speed the transfer and commercialization of scientific and technological achievements, and serve the construction of economy and society via various platforms such as information distribution, patent incubation, cooperation between academies and local governments.
(24) To explore ways of creation and utilization of national defense intellectual property rights in the scientific research and production system of national defense with a development mode of military and civilian integration.
II. Strengthening IP Protection
(I) Formulating and Revising IP Laws, Regulations and Regulatory Documents

(48) In order to cooperate with the implementation of the Intangible Cultural Heritage Law, to formulate the Policies on Supporting the Protection of the Productivity of Intangible Cultural Heritage, Policies On the Inheritor and Inheritance Mechanism Construction of the Intangible Cultural Heritage, Norms on the Categorized Protection of the National Intangible Cultural Heritage, Compiling Regulations on General Plans for the National Cultural Ecology Reserve Regions, Procedures for the Management of Precious Relics of the Intangible Cultural Heritage, Protection Policies for the Intangible Cultural Heritage of Minorities with Small Population.
(49) To launch the research, formulation and promotion of intellectual property management norms of enterprises, and to promulgate related documents.
1. To Carry out Special Enforcement Campaigns
★ (50) To thoroughly implement the Action Plan on Special Campaign against IPR Infringements and the Production and Sales of Counterfeited and Forged Commodities, to organize and coordinate the special campaign, and to promote the construction of the long-term mechanism for IPR protection in China.
★ (51) To promote the use of legal software in government departments and businesses, to take effective measures to accomplish the inspection and rectifying work on using legal software in central and local government administrations on time in 2011, to cooperate with departments in charge of finance and government-affairs administration in fund guarantee and software assets management, and to construct a long-term working mechanism for using legal software and resisting pirated software. To further promote enterprises to use legal software, to give a full play to the industrial associations' positive role in promoting legal software in businesses, to accelerate the promotion of legal software in foreign-invested or privately owned enterprises, and to complete the pilot work of software assets management in 30 enterprises.
★ (52) To launch the special campaign against web infringement and piracy activities, to strengthen the supervision of websites, to enhance the combating of online infringement cases, and to fight against online sales of fake and/or inferior commodities, downloading services for pirated films, TV programs and dramas, and software, private servers or add-on operation for pirated online games, or other crimes of IPR infringement, so as to strengthen the online IPR protection, and to establish a normalized mechanism for copyright administrative protection on the Internet.
(53) To continue pushing on the Operation Strike of the Sword aiming to combat IPR infringements and the production and sales of counterfeited and forged commodities, to strengthen the effort in guidance, coordination, supervision and inspection, and to guarantee the nationwide promotion of the special operation.
(54) In line with the Circular on Providing Good Legal Service by Lawyers for the National Special Campaign against IPR Infringements and the Production and Sales of Counterfeited and Forged Commodities, to organize and guide lawyers to do a good job in defending for cases involving IPR infringements and the production and sales of counterfeited and forged commodities.
(55) To organize agricultural administrations nationwide to implement the Action Plan on the Special Campaign against Infringing upon Variety Rights and Producing or Selling Fake or Inferior Seeds, to expose a group of infringing and counterfeiting enterprises to public, and to destroy fake and/or inferior seeds.
(56) To organize and carry out the special campaign of regulating cultural market, and to continue to carry out the special campaigns for regulating Internet and mobile media information, against IPR infringements and the production and sales of counterfeited and forged commodities.
(57) To carry out self-supervision and self-correction activities in central enterprises, in cooperation with the special campaign against IPR infringements and the production and sales of counterfeited and forged commodities, and guide central enterprises to formulate corresponding plans for rapid response to IPRs.
(58) Under the requirements of the Special Campaign against IPR Infringements and the Production and Sales of Counterfeited and Forged Commodities, to actively implement and deploy the campaign among all customs in China, and remain the high-pressure stress on fighting against infringement activities during importation and exportation, to strengthen analyzing and processing infringement information in different ways, to continue fulfilling the mechanism of cooperating with IPR owners, and to implement a precise cracking down upon the illegal activities in importing and exporting infringement commodities.
(59) To improve the substantial results of the Special Campaign against IPR Infringements and the Production and Sales of Counterfeited and Forged Commodities, to emphasize on illegal behaviors of infringing foreign-related trademarks and well-known trademarks, to practically constrain malicious registered trademark, and strictly investigate and punish illegal printing of trademark labels and counterfeited packaging designs of famous commodities.
(60) To push and implement all the works in the Special Campaign against IPR Infringements and the Production and Sales of Counterfeited and Forged Commodities in production, emphasize on some key areas, and actively research and establish a permanent IPR protection mechanism for cracking down upon counterfeits, to actively push the construction of hotline "12365", the report and management command system, continue working on "cracking down upon counterfeits, protecting famous and excellent commodities".
(61) To organize the key areas in the Special Campaign against IPR Infringements and the Production and Sales of Counterfeited and Forged Commodities to destroy confiscated pirated publications, to supervise key cases by requiring limited time on concluding cases.
(62) To organize and carry out special campaign against producing or selling fake or inferior forest germchit and for protecting new varieties of plants, to strictly crack down upon producing or selling fake or inferior forest germchit, and investigate and punish illegal activities such as unlicensed production and sale of forest germchit, infringing and counterfeiting new varieties, and etc., and to protect the breeders’ rights according to the law.
(63) To organize the implementation of the Plan on the Special Campaign of Law Enforcement by IPR Administrations, to firmly crack down upon repeated and malicious patent infringement in a large amount or passing-off patent activity, to enhance capability of handling IPR complaints, to promote the construction of IPR assistance centers, to strengthen the IPR protection in exhibitions, to strengthen the inter-departmental and inter-regional enforcement cooperation, to promote the coordination and cooperation between administrative enforcement and judicial protection, and to try best in reviewing and supervising law enforcement.
(64) To actively cooperate with the Special Campaign against IPR Infringements and the Production and Sales of Counterfeited and Forged Commodities according to the law, to strengthen the judicial protection against criminal violations of IPRs, to strictly punish the criminal IPR violations, so as to give a full play to the punishment and deterrence function against crimes.
(65) To actively participate in the Special Campaign against IPR Infringements and the Production and Sales of Counterfeited and Forged Commodities, to severely fight against crimes of IPR infringement, to ratify arrests and prosecute cases in time, and to strengthen supervision of important and influential cases.
2. Strengthening Regular Enforcement
(66) To organize the compilation of the Guidance Manual for Handling IPR Crimes, so as to help front-line law enforcement officers correctly understand and apply relevant laws, and to regulate the acceptance procedures and handling of cases.
(67) To strengthen the research of DNA and other appraisal technology for law enforcement, to formulate the regulation on DNA finger-print appraisal process for some major crops, to support the establishment of qualified plant varieties appraisal agencies, and to improve the enforcement appraisal system for plant varieties.
(68) To actively launch market inspection on pre-installation of pirated computer software, to focus on strengthening the management from the source of computer manufacturers, and to enhance the market supervision on software or other key products.
(69) To promulgate the Guiding Opinions on Copyright Administrative Enforcement, so as to further improve the copyright administrative enforcement system and support administrative enforcement agencies to carry out copyright enforcement in culture market.
(70) To establish a mediation mechanism for copyright disputes, and to basically form a civil mediation mechanism with an effective linkage between the judicial and administrative agencies.
(71) To organize the formulation and promulgation of China's Action Plan on Intellectual Property Protection 2011.
(72) To push the establishment of IP assistance centers, to deeply carry out the "5.26" Law Enforcement Promotion Project and the construction of National Key Liaison Bases on Patent Protection.
(73) To ensure the protection of geographical indications by strengthening the supervision and random inspection and harshly cracking down the infringement and counterfeiting of geographical indications.
3. Strengthening IPR Judicial Protection
(74) To continue promoting the pilot work on hearing all civil, administrative and criminal IPR cases at the IP tribunals.
(75) To effectively improve the jurisdiction system of civil IPR cases, to further expand the jurisdiction of local courts over common IPR cases, and improve the territorial jurisdiction of selected courts.
(76) To launch "the Three Fives Program" to strengthen the infrastructure construction of local courts on handling IPR cases, that is to select five primary courts that have jurisdiction over IPR cases as the first group of demonstration local courts in China's IPR judicial protection, select five intermediate courts as the first group of IPR judicial protection research bases of the Supreme People's Court, and select five key colleges and universities as the first group of the IPR judicial protection research bases of the China’s people’s courts.
(77) To carry out "Special Activity for Supervising the Administrative Enforcement Authorities to Transfer Suspicious Criminal Cases Violating IPRs", to seriously investigate the administrative authorities for cases should be transferred, accepted, or punished but handled otherwise, and for cases should be sentenced to criminal punishment, but only given fines, and for behaviors playing favoritism and committing irregularities, and etc, and to supervise and correct these behaviors without delay.
(78) To further promote the "Linkage of Two Laws", actively promote administrative enforcement and criminal judicial authorities to establish a mechanism characterized by "network linkage and information sharing".
III. Promoting IPR Services
(79)To improve the IP services in the technology market, incubators, science parks of universities, productivity promotion centers and other intermediary service agencies, so as to promote the IP service capability.
(80) To support the intellectual property information processing and strategic analysis in key areas, integrate IP information in key areas, and promote the IP information sharing in key areas, and make them accessible to units undertaking the programs of the National Science and Technology Plans.
(81) To organize and formulate the regulation on IPR judicial appraisal classification, requirements for admission and practice, and other documents related to IPR registration management.
(82) To strengthen communication and coordination on issues related to lawyer's practice in patent and trademark agency, to create conditions for lawyers to practice in patent agency, and to promote the promulgation of regulatory documents on lawyer's practice in trademark agency.
(83) To study and formulate Guidance for Lawyers to Practice in Patent Businesses, Guidance for Lawyers to Practice in Trademark Businesses and other business operation instructions, so as to help China's lawyers to conduct patent, trademark and other IPR-related business.
(84) To include more IPR intermediary organizations to serve for the implementation of the outline of agricultural IPR strategy, so as to support agricultural enterprises, public institutions, and social organizations to launch relevant service activities linked by agricultural IPRs, and to instruct the IPR Union of Seed Industry to carry out seed IP information sharing and assistance work.
(85) To continue the construction plan for the technology support system on the protection of new varieties of plants, to improve the function of test institutions on new varieties of plants and their regional arrangement, and to make efforts in the construction of a world-class plant variety test system.
★ (86) To continue disseminating overseas pre-warning and guidance information on IPRs to enterprises in different ways and to improve the overseas IP protection mechanism through compiling the Annual Report on Overseas IP Protection, publishing industry report on patent information analysis, providing training to enterprises on IPR protection, continuing the establishment of "IPR helpdesks for Chinese enterprises in exhibitions" in major international exhibitions, and several other ways, to guide and help Chinese businesses to handle key IP disputes in foreign-related trade, and to promote the pilot project of the overseas IPR protection center for enterprises.
(87) To carry out periodical exchange with the US on issues related to "337 Investigation", actively organize the appraisal activities for legislative amendments on Section 337, to express the concerns of China's industry and enterprises, and to strengthen instructions on how to handle 337 investigation for enterprises who are engaged in major cases, and simultaneously, try to coordinate with all departments to give policy support and assistance for enterprises that win lawsuits concerning “337 Investigation”.
(88) To promote the information construction on the protection of intangible cultural heritage, to formulate the construction plan of digitalized protection project of intangible cultural heritage, to formulate a unified standard system of digitalized intangible cultural heritage, to make an overall planning for the construction of intangible cultural heritage database, and to form a preliminary database system to serve the public.
(89) To continue supporting the construction of the animation public technology service platform, to formulate the service norms and standards for the animation public technology platform, to complete the construction of the animation public information service platform, and to build the animation public material database.
(90) To promote the implementation of the Guidelines for Strengthening the Traditional Chinese Medicine IPR work, and to increase the capacity of creation, utilization, protection and management of the intellectual property rights of the industry through organizing trainings and so on.
(91) Based on the complete elimination of the backlog of trademark examination, to continue promoting the plan of reaching the international level in trademark work in 5 years.
(92) To strengthen the construction of trademark infrastructure, make better use of the on-line application for trademark registration, to actively increase the scope and the proportion of on-line application, and to continue promoting the cooperation with the World Intellectual Property Organization (WIPO) in the construction of Madrid electronic communication system.
★ (93) To continue promoting the construction of IP organizations for radio, film and television industries, to guide the Film Copyright Association, the Committee on Television Copyright of China Radio and Television Association, and the Committee on Radio Copyright of China Radio and Television Association to launch work, and to continue promoting the preparation for the establishment of the China Internet Audio-Visual Program Service Association.
(94) To make full use of Shanghai International Film Festival, "Beijing Showings" and other radio, television, and film festivals or exhibitions, to provide platforms of program exchange and copyright marketing to the copyright and other relevant right holders, to construct the international marketing networks of film and television products, and encourage enterprises to launch program copyright exchange and marketing towards the international market.
(95) To give a full play to the functions of collective administration organizations, industrial associations, and copyright intermediary organizations, to further regulate their market behavior, and to support their legitimate business activities, so as to create conditions for their development.
(96) To innovate on the copyright public service methods, enhance the copyright public service capacity, and increase the quantity and improve the quality of registered works and recorded registrations of copyright contracts.
(97) To emphasize on construction and improvement of forestry-related IP basic databases, which contain new forestry plant varieties, forestry-related patents, geographical indications and etc., and to further improve the public information platform for forestry-related IPRs, and the pre-warning mechanism for IPRs of major exporting forestry products, to initiate the China Forestry IPR Network, and support the foundation of protection unions in different forms, so as to provide service for the creation, protection, and utilization of new forestry plant varieties.
★ (98) To circulate and implement the Guidelines for Strengthening Patent Analysis Work in China, to cultivate the national patent analysis system, to choose key scientific and technological projects, key industries, and key technological areas to deeply launch patent analysis work, and to carry out projects on distribution and popularization of patent analysis.
(99) To launch industrial IPR strategies in key industries and major technology areas, to enhance the IP awareness of industries, to increase the ability of industries in creation, utilization, protection and management of IPRs, and to establish the IP management mechanism of industries.
(100) To keep on promoting electronic application of patents, to improve the electronic application system, to accelerate the project for transforming paper application to electronic application system, and to implement a package of methods in promoting electronic application.
(101) To continue promoting public service for patent information, to construct patent information service platform for strategic and newly emerging industries, to improve the patent information service platform for key industries, and to cultivate the advantageous industry associations in patent information utilization.
(102) To establish the assistance mechanism for patent agency, to clarify the operation criterion, and to implement the Promotion Plan for Patent Agencies Ability, so as to comprehensively improve the service level of patent agencies.
(103) To construct a national public service platform system for patent utilization and industrialization, to promote the level of IT application in the platform, and to strengthen the comprehensive service capability of the platform.
(104) To steadily implement the Straits Cooperation Agreement of IPR Protection, so as to further enhance the cooperation across the Taiwan Straits in patents, trademarks, copyrights, new plant varieties and other areas.
(105) To enhance the capability in examination of national defense patents, to steadily increase the number of examiners, optimize the procedures for examination, to enhance intermediary IP services for national defense patents, to establish and improve the management norms and regulations in national defense industries, and to gradually broaden the scope and density of national defense IP service.
IV. Enhancing IP Education and Training and Team Building of IP Talents
★ (106) To include the building of national IP talents training base into the Plan on Education and Training of Excellent Legal Talents started in 2011, and to further enhance the training of professional IP talents.
(107) To continue carrying out short-term training of IP teachers, to organize the National Training Programs for IP Teachers in Universities and further improve the team building of high-level IP teachers.
(108) To continue encouraging and guiding the universities to set up IP-related majors, and to guide the universities to provide IP-related selective courses for students.
(109) To launch targeted IP training and tutoring programs for various innovative subjects and technology management staffs with different levels, to foster a professional analysis team of patent information relied on technology information institutions, scientific research institutions, universities and high-tech industry development parks and to support technology innovation with IP information.
(110) To continue promoting the training programs of on-job master-degree education on IP laws.
(111) To strengthen orientation training and post-education for IPR judicial appraisal employees, to organize education programs on professional ethics and disciplines, and to further improve the overall quality of the team.
(112) To make full efforts to attract the high-level overseas IP talents to serve the country in various forms, and to further strengthen the support for high-level IP talents of returned overseas students to work and start up their own business.
(113) To organize post education and training programs on IP subjects of public needs in accordance with the knowledge-update project for professional technology talents, to formulate and implement special training plans and to carry out IP training and tutoring programs for enterprises, to include the evaluation results of the training as part of the assessment and registration content of post education for professional technology staffs.
(114) To further enhance the IP training for civil servants, strengthen guidance and supervision, continue to incorporate IP training in various training programs, and improve the awareness of IP protection among civil servants.
(115) To strengthen the protection for representative heirs with the national intangible cultural heritage, to initiate the rescue documentary project for representative heirs, to ascertain subsidy funds, to formulate detailed management rules and promulgate supportive policies, and to study and formulate tuition assistance, scholarships and other incentive measures for the apprentices and heirs.
(116) To continue organizing training programs for IP professionals in radio, film, and television agencies, so as to improve their theoretical and professional levels.
(117) To improve the training work of copyright, to organize copyright training for officials, enforcement officers, copyright owners and operators of copyright-related corporations, and to train professionals on copyright.
(118) In accordance with the task assignment requirements of the Outline of the National Mid- and Long- Term Talent Development Plan (2010-2020), to implement the organization work of the Implementation of IPR Protection and promulgate detailed measures and means.
★ (119) To study and promulgate Hundred and Thousands of IP Talents Project of 2011-2015, to accelerate the building of National IP Talent Training Base Construction Project, to further implement Informationization Project of IP Talents, and to establish the national IP talent pool and provincial IP talent pools.
(120) To further promote the system building of special IP personnel, to enhance the training of special IP personnel, and expand the special IP personnel team, to improve their IP strategy management and planning ability.
V. Enhancing the Publicity Work and Intellectual Property Culture
(121) To combine the IP publicity work with review of eleventh five-year and outlook of twelfth five-year plans and accelerating the transformation of economic development mode together, to fully report the significant achievements with the implementation of the national IP strategy and strengthening the creation, utilization, protection and management of IP.
(122) To further strengthen the publicity and report of special campaign against IPR infringements and the production and sales of counterfeited and forged commodities, to report the effective measures taken by regions and departments timely, to fight against IPR infringements and the production and sales of counterfeited and forged commodities, to enhance the development of intellectual property protection, to take full advantage of public supervision and report typical cases in the special campaign, to expose the IPR infringements and to make efforts to create a favorable climate of protecting IPR and consciously resisting against the IPR infringements and the production and sales of counterfeited and forged commodities in the society.
(123) To strengthen the external publicity on typical intellectual property issues considering the focus of the world’s attention, to fully report the improvement in intellectual property protection environment in China, to show the determination of the Chinese government to severely crack down on IPR infringements and to make the world aware of the development of China’s intellectual property protection work objectively, impartially and comprehensively.
★ (124) During the national IP publicity week, and on the anniversary of the promulgation of the Outline of the National Intellectual Property Strategy and other important dates, to promote the publicity of IP laws and regulations and scientific knowledge around the theme of the activities, and with the forms that are delightful and familiar to the public, to strengthen the awareness of IP among the whole society and to enhance the IP cultural building of “Respecting Knowledge, Advocating Innovation, Being Honest and Credible, and Abiding by Laws” .
(125) To encourage local governments and schools to take advantage of the disposable classes provided by the Plan for Curriculum Settings of Compulsory Education to organize educational activities on the protection of intellectual property, and to guide the teaching materials’ compiling group of ideological and moral curriculum to revise the textbook in accordance with the curriculum standards on IP education.
(126) To take advantage of the Achievement Exhibition of Science and Technology Development in the Eleventh Five-Year Plan to strengthen the publicity and promotion of IP achievements in science and technology innovation and to make efforts to create a favorable IP culture of science and technology innovation in the society.
(127) To organize the selection of significant technical inventions in major industries, so as to encourage the enterprises to innovate.
(128) To open up special page or column of IPRs on newspaper, radio, TV and other media, to publicize the work of public security agencies to fight against the IP infringements related to social well-being issues, to improve the IP awareness of the public, and to make efforts to create a favorable climate of promoting the implementation of intellectual property strategy in the society.
(129) To deploy the publicity and education work of intellectual property legal system based on the Main Points of National Dissemination of the Law and Ruling according to Law in 2011, to continue promoting “six entries of laws” according to the requirements of the “sixth-five” law popularization and promote the intellectual property laws and regulations entering government agencies, rural areas, communities, schools, enterprises and work units.
(130) To guide members of intellectual property alliance of seed industry to send honesty, credit and law-abiding written proposal to the whole industry, to compile publicity brochure on the protection of the new varieties of plants in accordance with the 50th anniversary of foundation of the International Union for the Protection of the New Varieties of Plants and to organize the 5th National Agricultural Intellectual Property Forum.
(131) To further promote the publicity activities on the overseas’ IP protection and the IP protection issues to be noted by enterprises attending international exhibitions, to make full use of the websites including the Intellectual Property Protection in China, National Intellectual Property Strategy and other platforms for the information dissemination and publicity work of intellectual property.
(132) To hold the international seminars on pharmaceutical data protection system and further discuss the implementation strategies for relevant systems of pharmaceutical test data protection.
(133) To award the International Golden Prize for Chinese Trademarks with WIPO, to carry out the work of Provincial Governors’ Opinions on Trademark Strategy Implementation and Mayors’ Opinions on Trademark Strategy Implementation, to organize seminars on strengthening self-owned brand construction with industrial associations in key industries, to publicize trademark-related knowledge and enhance the awareness of trademark strategy among corporations.
(134) To take full advantage of mass media to organize and coordinate radio and TV programs to actively promote the publicity work of the Outline of the National Intellectual Property Strategy, to make full efforts to publicize the experiences and achievements of IPR protection and special campaigns against the production and sales of counterfeited and forged commodities.
(135) To take the advantage of the 20th anniversary of the promulgation of the first Copyright Law of the People’s Republic of China to carry out significant publicity and education campaigns and strengthen the public-welfare publicity work of copyright.
(136) To develop and establish a complete statistical system for copyright industry and carry out survey on contributions of copyright-related industries to national economy in 2009.
(137) To organize relevant work of “4.26” national IP publicity week themed “IPRs Boost Economic Transformation” in cooperation with relevant agencies, and to continue enhancing the building of IP culture.
(138) To make full efforts to carry out the 5th Patent Week and China Patent Award Selection Campaign, to enhance publicity and continue organizing central media to make typical reports of the corporations with an IP advantage.
(139) To draft and promulgate the Intellectual Property Protection in China in 2010 and the Summary of National and Local Intellectual Property Protection in 2010.
(140) To organize the relevant volunteer work on national intellectual property protection.
(141) To organize the annual campaign themed “Strengthen Judicial Protection of Intellectual Property Right, Promote Change in Economic Development Mode” among nationwide courts, and convene national court public seminar on IPR judicial protection.
(142) To select and publish top 10 Cases and 50 typical IP cases for judicial protection in China in 2010, to publish the IPR Judicial Protection by Courts in China (2010) and issue the Annual Report on IP Cases by the Supreme People’s Court (2010), to establish the Internet website titled China IPR Judgments and Decisions.
(143) To make full efforts to launch IP publicity campaigns in national defense technology and armament construction, so as to improve the awareness of IP protection of national defense.
(144) To strengthen the publicity and training work on the protection of geographical indications, to further popularize knowledge of geographical indications’ protection and improve the ability to recognize the geographical indications of the society.
VI. Expanding Foreign Exchanges and Cooperation on IP
★ (145) To continue to support international exchanges and cooperation in the IP field, and to further communicate on IP protection issues through high-level meetings, and bilateral and multilateral cooperation mechanism with major countries.
(146)To further strengthen the cooperation with World Intellectual Property Organization, by implementing the Memorandum of Understanding on Cooperation, and cooperate on personnel training, subject discussions and research programs to support the IPR work of scientific and technological innovation.
(147)To organize international negotiation on “national system for access to and benefit sharing of genetic resources” under the Convention on Biological Diversity, and to study the Nagoya Protocol in depth, preparing for the conservation of species resources.
(148)To actively participate in relevant meetings and activities on the Treaty of Protection of New Varieties of Plants, to enhance the bilateral and multilateral cooperation with the Netherlands, Germany and Japan on the protection of new varieties of plants, to make a good preparation for the East Asia Forum on Protection of New Varieties of Plants, so as to promote the technology communication and cooperation on new varieties of plants in East Asia.
(149)To enhance the dialogue and IPR working mechanism between China, and the Untied States, EU, Japan, Russia, Brazil and Switzerland, lead the negotiation on Sino-EU and Sino-Switzerland Bilateral Cooperation Agreement on Geographical Indications, promote the bilateral economic and trade relationship, further establish the China-US IP cooperation programs, and discuss the establishment of new China-EU IP cooperation programs.
(150)To promote the program of China IP Protection Overseas Promotion Publicity Week in the US, EU and Japan.
(151)To lead the participation in the conference of TRIPs Council of WTO and the APEC Intellectual Property Expert Group Meeting, to actively engage in discussion and negotiation on various IP issues, and to carry out IP information exchanges.
(152)To coordinate and engage in IP negotiations of free trade area and to fulfill the obligations concerning IP chapter or articles in the agreements that have come into force.
(153)To continue to dispatch participants to the conferences of WIPO, APEC and WTO, to continue to follow the process of the Standing Committee of Trademark, Industrial Designs, and Geographical Indications and Madrid Legal Development Working Group Meetings, and to actively utilize international rules to protect China's trademark rights and interests.
(154)To enhance the exchange and collaboration with WIPO, Asia Broadcasting Union (ABU) and other international organizations, and to actively participate in the formulation of the WIPO Treaty on the Protection of Broadcasting Organizations.
(155)To further complete the follow-up work of China-US Joint Commission on Commerce and Trade related to copyright affairs, organize the China-US Internet Copyright Conference, and promote the implementation of the Memorandum of Strategic Cooperation on Copyright between China and the United States; To further promote and implement the 2010-2011 Work Plan of China-UK Memorandum of Understanding on Copyright, to implement the relevant work under the framework of China-Japan and China-South Korea Copyright Cooperation Memorandum, and to actively participate in the relevant work of China-Australia, China-Peru and China-Costa Rica free trade area negotiation and IP working group meeting of China-Brazil and China-Russian economic and trade committees.
(156)To lead the participation of international negotiation and discussion on issues like development agenda, protection of traditional knowledge and folklore and reform of Patent Cooperation Treaty under WIPO framework, and continue to promote the balanced development of international IP regime.
(157)To deepen the cooperation with the United States, Europe, Japan and South Korea in the patent field, and to steadily promote the implementation of the ten fundamental programs related to patent classification, documentation, automation, examination and training.
(158)To deepen the bilateral patent cooperation and exchanges with the United States, the United Kingdom, France, Germany, Austria, Russia, Japan, South Korea, Brazil, Australia, Mongolia and other countries, and to implement the bilateral IP cooperation agreements.
(159)To thoroughly implement the Memorandum of Understanding between China and ASEAN Countries on IP Cooperation, to expand the scope of cooperation, and to hold the China-ASEAN IP Seminar.
(160)To further promote and expand the cooperation with African Intellectual Property Organization (OAPI) and African Regional Intellectual Property Organization (ARIPO), and strive to open the new bilateral relationship with IP agencies of major African countries.
(161)To continue the deepen the international cooperation in the area of geographical indications, to make efforts to achieve the information sharing among the main geographical indication partners, and to protect the legitimate interests of both domestic or foreign right owners of geographical indications under the principle of equity and reciprocation.
VII. Strengthening Organization and Coordination of the Implementation of the National IP Strategy
(162)To organize and hold the Inter-Ministry Joint Meeting on the Implementation Work of the National IP Strategy, to supervise and evaluate the Implementation Plan of the Strategy, and to thoroughly carry out the work of survey and research, training, and the establishment of the strategy implementation research centers.
(163)To strengthen the construction of IP strategy information platform, to develop the Work Briefings and the Work News of the Joint Meeting and the IP strategy website well, and to ensure the timely and efficient communication of IP strategy information.
(164)To organize the publicity work of the 3rd anniversary of the Implementation of the National IP Strategy, to hold the achievement exhibition for the implementation of the strategy, to compile and publish the Policy Book on National IP Strategy, and to produce the publicity film on the strategy.
(165)To accelerate the organization of formulating the Outline of the 12th Five-Year Plan, the National Special Projects Plan and the National Plan on Key Regions, to strengthen the research and analysis of the important tasks and objectives of the IP work, and to implement the IP strategy to every aspects of social economic development with specific policies and measures.
(166)To formulate and release the 12th Five-Year Special Plan on IP Work of Science and Technology Innovation, and to comprehensively instruct science and technology administrations and innovators to implement the IP strategy.
(167)To draft, print and distribute the 2011 IP Work Promotion Plan of the Ministry of Industry and Information Technology, and to thoroughly develop the industry IP work with the main subject of accelerating the change of developing pattern and by defining the major annual IP work and assignments subjects.
(168)To promulgate and carry out the IP Administrative Regulation on Pharmaceuticals and Public Health, to implement the national IP strategy in the pharmaceutical and public health area, and to promote the protection, exploitation, utilization and establishment of management system of intellectual property on medicine and public health.
(169)To study and formulate specific instructive suggestions timely and appropriately towards the key problems in implementing IP strategy by the large state-owned enterprises.
(170)To further promote the implementation of the national trademark strategy, and to strengthen its demonstration and service work.
(171)To complete and improve the Decision on Implementing the Outline of the National IP Strategy, Implementing Trade Secret Protection Administrative Enforcement Strategy, and on Effective Protection of the Market Order on Fair Trade (Draft), and to actually carry out the implementation of trade secret protection administrative enforcement strategy.
(172)To lead the formulation of the 12th Five-Year Plan of Intellectual Property and the drafting and release work of the 12th Five-Year Plan on Patent Work.
(173)To further develop the formulation and implementation of local IP strategy. To organize the annual activities for selecting IP strategy demonstration provinces. To start the regional IP strategy implementation and evaluating work, to issue normative documents to instruct local strategy implementation and evaluation, and to start the evaluation work first in some provinces. To strengthen the training exchanges on local IP strategy implementation, and to further promote the implementation of local IP strategy from provinces to cities.
(174)To further strengthen the IP work in key regions and districts. To organize the survey and research of the IP work situation in key regions and districts, to promote the linkage between the IP strategy and regional planning, to release Opinions on Implementing IP strategy and Promoting and Accelerating the Development of IP work in Western Regions, and to continue to do a good job on the IP related work in national key regions and districts.
(175)To strengthen the research work on IP development strategy and management policy, to study and formulate the Promotion Plan of IP Work by the Chinese Academy of Sciences, and to instruct the IP work of the entire academy during the 12th Five-Year Plan period.
(176)To complete and improve the preliminary implementation plan of national defense IP strategy, and to complete the implementation plan of specific assignments.
